Terms of Service.
1. Introduction and Acceptance
These Terms of Service (the "Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Accelerated Pilot, LLC ("Accelerated Pilot," "we," "us," or "our") governing your access to and use of the website located at acceleratedpilot.com (the "Site"), our online courses, coaching services, and related materials (collectively, the "Services").
By accessing the Site, purchasing any Service, creating an account, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not access the Site or use our Services.
2. Description of Services
Accelerated Pilot provides flight training content for aspiring and active pilots, delivered through virtual reality (VR) flight simulation by FAA-certificated flight instructors. Our Services include, without limitation:
- Self-paced video instruction organized into structured courses
- Pre-built scenarios for use with Microsoft Flight Simulator 2024
- Mission workbooks and custom aircraft checklists
- Optional one-on-one coaching sessions with FAA-certificated flight instructors, including Phase Check evaluations and Graduation Phase Check evaluations
- Supporting materials and resources
The Accelerated Pilot curriculum is designed and delivered by FAA-certificated instructors authorized under 14 CFR Part 61. However, the home VR environment used to deliver our courses is not an FAA-approved training device, simulator, Aviation Training Device (ATD), Basic Aviation Training Device (BATD), or Advanced Aviation Training Device (AATD). Time spent completing Accelerated Pilot courses cannot be logged toward FAA aeronautical experience or flight time requirements. Completion of any Accelerated Pilot course does not, by itself, result in an FAA certificate, rating, endorsement, or currency. Students are solely responsible for obtaining all FAA-required training in appropriate aircraft, training devices, or simulators, and for complying with all applicable regulations.
The ground review component of the Graduation Phase Check within the Coached tier constitutes ground training by an authorized instructor under 14 CFR Part 61 and will be logged in the student's logbook with an appropriate endorsement.
3. Eligibility and Account Registration
3.1 Age Requirements
You must be at least 18 years of age to purchase any Service. If you are a minor (under 18 years of age), a parent or legal guardian must complete the purchase on your behalf, create and maintain your account, and accept these Terms on your behalf. The parent or legal guardian is responsible for all activity on the account.
3.2 Account Accuracy
When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3.3 One User Per Account
Each account is intended for use by a single individual. Sharing of account credentials with others is prohibited and constitutes a material breach of these Terms.
4. Purchase and Payment Terms
4.1 Pricing
All prices are displayed on the Site in U.S. dollars and are subject to change without notice. The price in effect at the time of your purchase will be the price charged.
4.2 Payment
Payment is due at the time of purchase. We accept payment via the methods displayed at checkout. By submitting payment, you authorize us (or our payment processor) to charge the full purchase amount to your payment method.
4.3 Taxes
You are responsible for any applicable sales tax, use tax, VAT, or other taxes imposed by any governmental authority on your purchase.
4.4 Refunds
Refunds are handled in accordance with our Refund Policy, which is incorporated into these Terms by reference.
5. License and Use of Course Materials
5.1 Limited License
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial educational use.
5.2 Intellectual Property
All content provided through the Services — including but not limited to video lessons, scenarios, mission files, workbooks, checklists, written materials, graphics, logos, trademarks, and software — is the exclusive property of Accelerated Pilot or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
5.3 Prohibited Uses
You may not, and you may not permit any third party to:
- Copy, reproduce, distribute, publicly display, or publicly perform any course content
- Download, save, or export video lessons, except as expressly permitted
- Share your account credentials with any other person
- Provide access to the Services to any person who has not individually purchased them
- Resell, sublicense, or commercially exploit the Services or any course content
- Use the Services or course content to create competing products or services
- Reverse engineer, decompile, or attempt to extract source code from any software component
- Remove or modify any copyright, trademark, or proprietary notices
- Use the Services for any unlawful purpose or in violation of these Terms
Violation of this section constitutes a material breach of these Terms and may result in immediate account termination without refund, as well as legal action to protect our intellectual property.
6. Coaching Sessions and Phase Checks
6.1 Scheduling
Coaching sessions are scheduled via our website contact form. Enrolled students receive direct scheduling contacts in their welcome email. All sessions are scheduled in Eastern Time. Sessions must be scheduled within the applicable time window associated with your enrollment.
6.2 Cancellation and Rescheduling
Scheduled coaching sessions may be rescheduled without penalty if rescheduled at least 24 hours in advance. Sessions cancelled or missed with less than 24 hours' notice may be forfeited at our discretion.
6.3 Flight Recording Submissions
Coaching sessions involve your submission of flight recordings created with flight recorder software integrated with Microsoft Flight Simulator 2024. By submitting a recording, you grant Accelerated Pilot a limited license to review and analyze the recording for the purpose of providing coaching services. We will not share, publish, or commercially use your recordings without your express written consent.
6.4 Coaching Availability
Coaching is provided by FAA-certificated flight instructors affiliated with Accelerated Pilot. We reserve the right to assign coaching sessions to any qualified instructor on our team. For courses requiring specific certifications (such as Learn to Fly In the Clouds, which requires Certified Flight Instructor – Instrument qualifications), sessions will be assigned to appropriately certificated instructors.
6.5 Graduation Phase Check and Certificate of Completion
Students in the Coached tier may earn a Certificate of Completion by successfully passing a Graduation Phase Check to FAA Airman Certification Standards (ACS). The Certificate is issued by the FAA-certificated flight instructor who administers the evaluation and documents:
- Successful completion of the course curriculum
- Demonstrated flight performance to ACS standards
- The FAA-loggable ground training component of the evaluation
The Certificate of Completion is not an FAA certificate, rating, endorsement, or currency. It is an internal Accelerated Pilot credential documenting completion of our curriculum. The Certificate is available only to students who complete a Graduation Phase Check as part of the Coached tier.
6.6 Ground Training Endorsements
The ground review component of the Graduation Phase Check qualifies as ground training under 14 CFR Part 61, delivered by an authorized instructor (your Accelerated Pilot CFI). Upon successful completion, your instructor will endorse your logbook for this hour of ground training in accordance with FAA Advisory Circular 61-65.
7. Ground School Prerequisite
The Graduation Phase Check requires the student to have completed an online Private Pilot ground school course (or the equivalent ground school for courses beyond Learn to Fly Solo). Accelerated Pilot does not provide ground school content. Students are responsible for obtaining appropriate ground school training from qualified third-party providers before scheduling a Graduation Phase Check.
8. User Conduct
You agree to conduct yourself in a respectful, lawful, and professional manner in all interactions with Accelerated Pilot, including with our instructors during coaching sessions. We reserve the right to terminate your access to the Services, without refund, for conduct that is abusive, harassing, threatening, discriminatory, or otherwise inappropriate.
9. Third-Party Services and Software
The Services are designed for use with third-party software and hardware, including Microsoft Flight Simulator 2024, flight recorder software, VR headsets, and related equipment. Accelerated Pilot does not provide or warrant these third-party products. You are responsible for obtaining, installing, and maintaining all third-party software and hardware required to use our Services.
Your use of third-party services is governed by those services' own terms and privacy policies, and Accelerated Pilot is not responsible for their practices or policies.
10. Disclaimers
10.1 Educational Content; Non-Approved Training Environment
THE SERVICES ARE FLIGHT TRAINING DELIVERED BY FAA-CERTIFICATED FLIGHT INSTRUCTORS OPERATING UNDER 14 CFR PART 61. HOWEVER, THE HOME VR ENVIRONMENT USED TO DELIVER OUR COURSES IS NOT AN FAA-APPROVED AVIATION TRAINING DEVICE, BASIC AVIATION TRAINING DEVICE, ADVANCED AVIATION TRAINING DEVICE, FLIGHT SIMULATOR, OR FLIGHT TRAINING DEVICE UNDER 14 CFR PART 60, PART 61, PART 141, OR PART 142.
FLIGHT TIME SPENT IN THE ACCELERATED PILOT VR ENVIRONMENT CANNOT BE LOGGED TOWARD THE FLIGHT TIME, INSTRUMENT TIME, OR AERONAUTICAL EXPERIENCE REQUIREMENTS OF ANY FAA CERTIFICATE, RATING, OR ENDORSEMENT.
10.2 Student Responsibility
YOU ACKNOWLEDGE THAT BECOMING A LICENSED PILOT REQUIRES TRAINING FROM FAA-CERTIFICATED FLIGHT INSTRUCTORS IN FAA-APPROVED AIRCRAFT OR FLIGHT TRAINING DEVICES. YOU ARE SOLELY RESPONSIBLE FOR DETERMINING YOUR READINESS FOR ANY REAL-WORLD FLIGHT ACTIVITY AND FOR COMPLYING WITH ALL APPLICABLE REGULATIONS.
10.3 "As Is"
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ACCELERATED PILOT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
IN NO EVENT WILL OUR AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THIS LIMITATION APPLIES WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify, defend, and hold harmless Accelerated Pilot, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your violation of any third party's rights
- Any content you submit or share through the Services
13. Account Termination
13.1 Termination by You
You may close your account at any time by contacting us through our website contact form. Closing your account does not automatically entitle you to a refund; refunds are governed by our Refund Policy.
13.2 Termination by Us
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or conduct harmful to our business or other users.
13.3 Effect of Termination
Upon termination, your license to use the Services immediately ends. Provisions of these Terms that by their nature should survive termination (including but not limited to Sections 5.2, 10, 11, 12, and 14) will survive.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of laws provisions.
14.2 Dispute Resolution
Any dispute arising out of or related to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules, except that either party may seek injunctive or equitable relief in court to protect intellectual property rights. Arbitration will take place in Hackensack, New Jersey, unless otherwise agreed. Each party will bear its own costs and attorneys' fees, except as otherwise awarded by the arbitrator.
14.3 Class Action Waiver
You and Accelerated Pilot agree that any dispute will be resolved on an individual basis and not as part of any class, consolidated, or representative action.
15. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated by updating the "Last Updated" date at the top of these Terms and, where appropriate, by notifying you via email or through the Services. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Accelerated Pilot regarding the Services.
16.2 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
16.3 No Waiver
Our failure to enforce any provision of these Terms will not constitute a waiver of that provision.
16.4 Assignment
You may not assign these Terms or your rights under them without our prior written consent. We may assign these Terms at our discretion.
